1 Purpose of verification

By uploading your health check test to the Gingr platform, you agree that the Gingr team will review the document solely to verify its validity and compliance with its health and safety standards. This includes verifying the test date and results for required conditions such as HIV, Syphilis, Gonorrhea, Chlamydia, Hepatitis B, and Hepatitis C.

2 Data handling and privacy

Your health check details will be treated with the utmost confidentiality. The uploaded document will be stored securely and only accessible to authorised Gingr personnel for verification purposes. Access to your data is strictly role-based and limited only to personnel essential for verification.Your health check details will be treated with the utmost confidentiality.  Gingr will not share, disclose, or use your health details for any purpose other than verification. If third-party services or processors are used for storage or verification, Gingr ensures these parties comply with all applicable data protection laws, including GDPR and Swiss FADP.

3 Retention policy

Uploaded health check documents will be retained only as long as necessary to verify compliance or for as long as legally required. Once the verification process is complete, the document will be securely stored or deleted following data protection laws.

    Gingr commits to deleting or anonymising your data after verification unless otherwise required by law. Users will be notified when data has been deleted or anonymised.

4 Legal compliance

Gingr is committed to complying with all applicable data protection and privacy regulations, including but not limited to:

  1. General Data Protection Regulation (GDPR) (for users in the EU/EEA).

  2. California Consumer Privacy Act (CCPA) (for users in California).

  3. Local data protection laws in your region.

  4. Swiss Federal Act on Data Protection (FADP), including requirements for data transfers outside Switzerland.

5 User responsibility

By submitting your health check document, you confirm that it is accurate and genuine. Submitting fraudulent or altered documents is strictly prohibited and may result in account suspension or termination. 
You are responsible for ensuring you meet the minimum age requirements to provide consent for processing your health data (16 years old under GDPR unless local laws specify otherwise).

6 Consent to Process Health Data

By uploading your health check document, you explicitly consent to Gingr processing your health data for verification. This processing is based on GDPR Article 6(1)(a) and Article 9(2)(a), requiring explicit consent for special category data. This consent is revocable at any time; however, revocation may result in the inability to maintain an active profile with a valid health check badge.

7 Withdrawal of Consent

Please contact our support team if you wish to withdraw your consent for Gingr to process your health data. Note that withdrawing consent will remove your health check badge and may impact your profile visibility. Upon withdrawal of consent, Gingr will delete or anonymise your data within 5 days and notify you upon completion.

8 Cross-Border Data Transfers

If your data is transferred outside the European Economic Area (EEA) or Switzerland, Gingr ensures that appropriate safeguards, such as Standard Contractual Clauses (SCCs), are in place to protect it.

9 User Rights

As a user, you have the following rights under GDPR and the Swiss FADP:

Right to Access: You can request a copy of your health data being processed.

Right to Rectification: Request inaccurate or incomplete data correction.

Right to Deletion: You can request the deletion of your data (right to be forgotten), subject to legal requirements.

Right to Restrict Processing: You can request the restriction of data processing under certain circumstances.

Right to Data Portability: You can request that your data be transferred to you or another service in a structured, commonly used format.

Right to Object: You can object to processing your data in certain situations.

10 Breach Notification

If a data breach affects your personal or health data, Gingr will notify you without undue delay and, where applicable, inform the relevant supervisory authority as required by law.

11 Updates to the Terms

Gingr reserves the right to update these Terms and Conditions. Users will be notified of any material changes via email or platform notification, and continued use of the service constitutes acceptance of the revised terms.

12 Governing Law and Dispute Resolution

These Terms and Conditions are governed by Swiss law for Swiss users and the applicable jurisdiction of users within the EU/EEA.

In disputes, the competent courts in the Canton of Zug (Switzerland) shall have jurisdiction. Gingr may also offer alternative dispute resolution methods before escalating to litigation.
